1. Agreement to Terms

By accessing or using LocalBites (operated by 2166613 Alberta LTD), including our website at localbites.ca and any related services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our service.

2. Description of Service

LocalBites is a food delivery platform that connects customers with local restaurants in Calgary, Alberta. We facilitate ordering, payment processing, and delivery coordination. We are not a restaurant or food preparation service.

3. User Accounts

To use certain features of LocalBites, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Updating your information as needed

You must be at least 18 years old to create an account and use our services.

4. Orders and Payments

Order Acceptance: When you place an order, it is an offer to purchase. The order is only accepted when the restaurant confirms it.

Pricing: All prices are displayed in Canadian dollars (CAD) and include applicable taxes. Prices may vary from in-restaurant prices.

Payment: We accept major credit cards and other payment methods as displayed. Payment is processed at the time of order.

Refunds: Refund requests are handled on a case-by-case basis. Contact our support team for assistance.

5. Delivery

Delivery times are estimates and may vary based on factors including restaurant preparation time, driver availability, traffic, and weather conditions.

You are responsible for providing accurate delivery information. LocalBites is not responsible for orders that cannot be delivered due to incorrect addresses or unavailability at the delivery location.

6. Restaurant Partners

Restaurants listed on LocalBites are independent businesses. LocalBites:

  • Does not control food preparation or quality
  • Does not guarantee accuracy of menu information
  • Is not responsible for food allergies or dietary restrictions
  • Encourages customers to contact restaurants directly with specific concerns

7. Driver Partners

Delivery drivers are independent contractors. Tips provided through the platform go 100% to drivers. LocalBites does not control driver conduct outside of platform guidelines.

As a driver partner, you agree to:

  • Maintain a valid driver's licence and vehicle insurance throughout your time on the platform
  • Enable GPS location services on your device while the Driver App is open
  • Handle all food orders with care and deliver in a timely manner
  • Follow all applicable traffic laws and regulations
  • Maintain a professional and respectful demeanour with customers and restaurant staff
  • Not tamper with, open, or consume any food orders

LocalBites reserves the right to suspend or deactivate driver accounts for violations of platform guidelines, customer complaints, safety concerns, or failure to maintain required documentation.

8. Location Tracking & GPS Services

For Driver Partners:

By using the LocalBites Driver App, you consent to the collection and use of your real-time GPS location data. This is essential to the functioning of our delivery service. Specifically, your location data is used to:

  • Assign delivery orders — We match you with nearby orders based on your current location to minimize travel time and maximize your earning potential
  • Provide real-time tracking — Customers can see their driver's live location on a map after an order is picked up, which improves the delivery experience and reduces support inquiries
  • Calculate delivery distances and fees — Accurate distance calculations ensure fair delivery fees for customers and accurate payouts for drivers
  • Safety and dispute resolution — Location history for active deliveries may be retained to resolve delivery disputes, verify completed deliveries, and support driver safety
  • Platform optimization — Aggregated, anonymized location data may be used to identify high-demand areas and improve service coverage across Calgary

How location tracking works:

  • Active while app is open — Location tracking is active whenever the Driver App is open in your browser, regardless of your Online/Offline status. This enables faster order matching and accurate availability tracking. When you close the app or log out, location tracking stops immediately
  • Update frequency — Your location is updated approximately every 30 seconds while the app is open. GPS data includes coordinates, heading, speed, and accuracy
  • In-app consent — When you first open the Driver App, you will be shown a clear location consent prompt explaining how your data is used. You must accept this to use the app. You may also be prompted by your browser to grant location permission, which you can revoke at any time through your browser settings
  • Data retention — Real-time location data is overwritten with each update (only your latest position is stored). Delivery route history associated with completed orders is retained for 90 days for dispute resolution, then permanently deleted

For Customers:

When your order is assigned to a driver and in transit, you can track the driver's live location on a map via the order tracking page. You will only see your assigned driver's location for your active order. No driver location data is stored on your device or retained after delivery is complete.

Data protection:

All location data is transmitted over encrypted connections (HTTPS/TLS), stored securely on our servers hosted in Canada, and handled in accordance with Alberta's Personal Information Protection Act (PIPA). We do not sell or share individual location data with third parties. For more details, see our Privacy Policy.

9. Prohibited Conduct

You agree not to:

  • Use the service for any unlawful purpose
  • Harass, abuse, or harm other users, drivers, or restaurant staff
  • Provide false information
  • Interfere with or disrupt the service
  • Attempt to gain unauthorized access to our systems
  • Use the service to commit fraud

10. Intellectual Property

The LocalBites name, logo, and all content on our platform are owned by 2166613 Alberta LTD and protected by Canadian and international intellectual property laws. You may not use our intellectual property without written permission.

11. Limitation of Liability

To the maximum extent permitted by law, LocalBites and its affiliates shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Food quality or safety issues
  • Actions of restaurants or drivers
  • Service interruptions or technical issues

12. Indemnification

You agree to indemnify and hold harmless LocalBites, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these terms.

13. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify users of material changes via email or platform notification.

14. Governing Law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Calgary, Alberta.
